These Terms & Conditions apply when you use the Memories Made Outside website or purchase products from us.
Please read them before placing an order.
1. About us

Throughout these terms, "Memories Made Outside", "MMO", "we", "us" and "our" refer to the business operating Memories Made Outside.
2. Our products
Memories Made Outside creates personalised artwork celebrating runs, walks, races, rides and other outdoor adventures.
Products may incorporate information supplied or selected by you, including routes, maps, photographs, names, dates, distances, times, event information and personalised text.
Because these elements are selected specifically for you, most physical products sold by Memories Made Outside are personalised and made to order.
3. Placing an order
When you place an order, you are offering to purchase the products shown in your basket subject to these Terms & Conditions.
After placing an order, you will receive an order confirmation.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:

a product is unavailable;

there has been an obvious pricing or technical error;

we cannot produce the submitted design;
-
content submitted breaches these Terms;
-
we reasonably suspect fraudulent activity; or
-
we cannot fulfil the order to the requested location.
If we cancel an order after payment has been taken, we will refund the relevant amount.
4. Personalisation and customer responsibility
You are responsible for checking the information used in your personalised design before completing your order.
This includes, where applicable:

names;
-
dates;
-
distances;
-
finishing times;
-
route information;
-
event information;
-
photographs;
-
spelling;
-
captions; and
-
other personalised content.
Where we reproduce information exactly as supplied or approved by you, we are not responsible for errors contained in the information you provided.
If we make an error during production, we'll put it right.
5. Routes, maps and GPS data
Some Memories Made Outside designs may be generated from GPS, GPX, mapping, route or activity information.
You are responsible for checking that the route displayed in your personalised design accurately represents the route or activity you want to commemorate before completing your order.
GPS and mapping data can contain inaccuracies caused by GPS devices, mapping services, recording errors, signal loss or other technical factors outside our control.
Our route artwork is intended as a visual representation of an activity or memory. It is not intended for navigation or safety purposes and should not be relied upon to navigate a route.
6. Photographs and content you upload
You may be able to upload photographs, images, text, route files and other content when creating a product.
You retain ownership of content you upload.
By uploading content, you confirm that:

you own the content or have permission to use it;
-
you have the right to allow us to reproduce it as part of your product;

its use does not infringe another person's copyright, privacy or other legal rights; and
-
the content is lawful.
You grant Memories Made Outside permission to use, reproduce, resize, crop, process and transmit the content as reasonably necessary to create, manufacture, deliver and support your order.
This permission does not give us the right to use your personal photographs in our advertising, social media or marketing without obtaining separate permission from you.
We may refuse to produce content that we reasonably believe is unlawful, abusive, hateful, sexually explicit, infringes intellectual property rights or is otherwise inappropriate.
7. Production partners
We work with specialist third-party printing, production, fulfilment and delivery partners to manufacture and deliver our products.
Information necessary to fulfil your order may therefore be securely shared with these partners, including your name, delivery address, product configuration and artwork or image files.

8. Prices and payment
Prices are displayed in pounds sterling (£) unless stated otherwise.
We are not registered for VAT, so no VAT is charged.
The total price payable, including applicable delivery charges, will be shown before you complete checkout.
Payment must be successfully authorised before an order can be processed.
We may change our prices at any time, but changes will not affect orders that have already been accepted.
9. Personalised products and cancellation
Most Memories Made Outside products are made specifically to your requirements.
The statutory cooling-off right that normally applies to some online purchases does not generally apply to goods that are made to a customer's specifications or clearly personalised.
You may contact us to request a change or cancellation before production begins and we'll do our best to accommodate it.
Once production has started, however, we cannot normally cancel or change an order.
This does not affect your statutory rights where goods are faulty, damaged, not as described or otherwise fail to conform to your legal rights.

10. Delivery
Estimated production and delivery times are provided on our website and in our Shipping Policy.
Delivery dates are estimates unless explicitly described as guaranteed.
We are not responsible for delays caused by circumstances outside our reasonable control, although we will take reasonable steps to help resolve delivery problems.
You are responsible for providing an accurate and complete delivery address.
11. Damaged, faulty or incorrect products
If your product arrives damaged, faulty, incorrectly produced or materially different from what you ordered, please contact us at hello@memoriesmadeoutside.com.
We may ask you to provide photographs of the product and packaging to help us investigate the issue.
Where appropriate and in accordance with your statutory rights, we will arrange a replacement, reprint, refund or other appropriate remedy.
Nothing in these Terms limits your statutory rights.
12. Product appearance
We make reasonable efforts to display our products accurately.
However, the colours shown on phones, tablets and computer monitors can differ from printed colours.
There may also be small variations associated with printing, framing, materials and manufacturing.
These variations do not necessarily mean that a product is faulty.
13. Image quality
The quality of products containing customer photographs depends partly on the quality of the images supplied.
You are responsible for supplying images of sufficient quality and resolution.
Where a poor-quality or low-resolution image has been supplied by you and is reproduced accurately, the resulting image quality will not normally constitute a manufacturing fault.
14. Intellectual property
Unless otherwise stated, the Memories Made Outside website, brand, logo, product designs, layouts, software, written content and other original materials created by us are owned by or licensed to Memories Made Outside.
They may not be copied, reproduced or commercially exploited without permission.
This does not transfer ownership to us of photographs, text or other original content that you upload when creating your personalised product.
15. Personal use
Products purchased from Memories Made Outside are intended primarily for personal use or gifting.
You must not reproduce, copy or commercially exploit our designs or templates without our written permission.
Please contact us if you are interested in commercial, club, event or wholesale use.
16. Website availability
We aim to keep the Memories Made Outside website available and accurate, but we cannot guarantee uninterrupted or error-free access.
We may occasionally update, modify or temporarily suspend parts of the website for maintenance, improvements or technical reasons.
17. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or your statutory rights relating to faulty or misdescribed goods.
Subject to applicable law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase.
18. Privacy
We process personal information in accordance with our Privacy Policy.
Information necessary to produce and deliver your order may be shared with carefully selected service providers involved in payment processing, website operation, production, fulfilment and delivery.
19. Changes to these terms
We may update these Terms & Conditions from time to time.
The terms applying to your purchase will normally be those published on our website when you place your order.
20. Governing law
These Terms are governed by the laws of England and Wales.
If you live elsewhere in the United Kingdom, you may also benefit from mandatory consumer protections and rights applicable where you live.
Nothing in these Terms affects any statutory rights that cannot legally be excluded.
